A wrongful death lawsuit against Lee Memorial Health System has gotten back on track after 13 years. The incident occurred in 1997 after an 81-year-old woman died after hip replacement surgery.
The woman’s daughter claims that the hospital lied about the true cause of her mother’s death. The hospital claims that the cause of death was a heart attack from the stress of surgery, but the daughter claims that it was an undiluted injection of heart medicine that killed her.
Though Lee Memorial has sovereign immunity for a lawsuit, if they are found guilty of fraud by lying, they could be liable for more than the sovereign cap.
