Creditor Harassment

Birmingham Alabama Fair Debt Collection Attorneys

Creditors do not have the right to harass debtors, lie to them, or invade their privacy. Thousands of individuals suffer from creditor harassment, invasion of privacy, fraud, denial of promised services, and other kinds of mistreatment every year.

The fair debt collection attorneys of Yearout & Traylor, P.C. aggressively challenge banks, insurance companies and agents, credit card issuers, and other businesses and merchants that mistreat their customers. Our experienced, knowledgeable lawyers can tell you, in a free initial consultation, whether your case has merit.

Unfair Bill Collection

Debt collectors are usually not even employed by the company you owe money to. They are usually companies hired by your creditors to harass you. You deserve protection against the often unethical tactics used by these companies.

The Fair Debt Collection Practices Act is very specific about what constitutes illegal bill collection tactics. Under this law, debt collectors can NOT:

  • Contact you at inconvenient places or times, such as early in the morning or late at night.
  • Contact you after receiving a letter from you saying to stop
  • Contact you at work
  • Tell anyone that you owe money
  • Threaten violence
  • Say that you have committed a crime
  • Say that they are an attorney, or that they work for a credit reporting bureau, when this is false
  • Charge you for anything more than your debt, except under certain circumstances
  • Use any false or deceptive means to collect a debt

If you have been victim to any of the above violation of fair debt collection, the attorneys of our firm will work hard to stop collector harassment immediately. We can also get you compensation for the emotional stressors the harassing treatment has caused.

Sued for Debt that is not Yours?

If you are being sued by a creditor for debt that is not yours, this is a violation of the Fair Debt Collection Act. In this situation, creditors are trying to recover a debt they have no right to collect.

If this debt is also being reported on your credit report, this is a separate violation of the Fair Credit Reporting Act. For more information about protecting yourself from erroneous creditors and to learn how to check your credit report please visit our checking credit reports page.
